From tomorrow (December 3), security services will be able to block websites. They will do this without the court’s consent.

Tomorrow (Tuesday, December 3), the amendment to the Act on Anti-Terrorist Activities and the Act on the Internal Security Agency and the Intelligence Agency will enter into force. It will allow security services to block websites without court permission. It introduces to Poland the EU regulation on preventing the dissemination of terrorist content on the Internet.

ABW will block websites

The vote on the amendment to the act took place a month ago. 429 MPs took part in it, of which 231 were in favor and 198 were against. None abstained. The new regulations allow the Internal Security Agency to block access to terrorist websites. Until now, this required court consent, but from tomorrow this will no longer be required.

The tasks of the head of the Internal Security Agency will include, among others, issuing orders that will oblige hosting service providers to remove certain content or block access to it. In addition, it will decide on the extension of such a ban and will verify orders issued by the competent authorities of other European Union countries. What’s more, ABW officers gained the right to enter the offices of hosting companies and view documents.

What sites can be blocked? Materials that may be considered terrorist content are:

  • incite to commit a terrorist offense;
  • incite a person or group of persons to commit or contribute to the commission of a terrorist offense;
  • incite a person or group of people to participate in the activities of a terrorist group;
  • they provide instructions on, among others, producing or using explosives or weapons in order to commit or contribute to the commission of a terrorist offense;
  • pose a risk of committing such a crime.

Such restrictions do not apply to materials distributed for educational, journalistic, artistic, research purposes or to raise awareness of the fight against terrorism.
