The taxman calls Poles on the carpet. Users of a well-known application are targeted

Although the tax office has not yet received the data from Allegro or OLX, the officials started to carry out inspections anyway. For now, they concern users of one website. How is this possible?

In our recent article “The tax office is starting to pick at Poles’ pockets. Here’s what you need to know” we informed that the inspections of the Tax Office in connection with the introduction of the EU DAC7 directive have not started yet. The reason is simple – no online sales platform has yet transferred data to the tax office. However, Vinted users report that they are already being called to the carpet – reports Wyborcza.biz. How is this possible?

The taxman went hunting

Both online sales platforms and the Ministry of Finance claim that the National Tax Administration has not yet received data on sellers.who had more than 30 sales transactions or their sum exceeded PLN 2,000. euro. For this reason, officials have not yet started mass inspections, which may mean penalties for many people if they filed their taxes incorrectly. However, Vinted users are an exception.

It turns out that Vinted is an exception. The website asked some users to complete the data and then forwarded it to the tax office. The thing is, not in Poland, but in Lithuania, where the DAC7 directive has been in force since January 2023.

Therefore, in 2023, we approached a small proportion of Polish members, asking them to provide their PESEL number as part of the pre-filled form. Based on the information they provided, we were obliged to report this to the Lithuanian tax authorities in January 2024.

And since the data was sent to the Lithuanian tax office, it is also made available to other tax authorities in the European Union. Therefore, the Polish Tax Office also has access to them and apparently uses this right carefully. Several users report that they have already been called on the carpet to provide explanations. If officials detect irregularities, they may impose a penalty.
