New tax from July 1? The tax office will definitely not give up

From July 1, the EU DAC-7 directive will come into force in Poland. It means huge changes for everyone who sells online. Allegro and OLX explain what exactly is going on.

In just a month, on July 1, 2024, an amendment to the Act on the exchange of tax information with other countries will enter into force in Poland. In practice, it will implement the EU DAC-7 directive in our country, which will largely affect all those who sell on the Internet. However, there is no reason to worry as long as you do not exceed the accepted limits.

Allegro and OLX will report on sellers

The DAC-7 directive introduces the need to collect and transfer data to the National Tax Administration on online sales platforms, e.g. Allegro, Vinted, OLX or Booking. This applies to all those who make at least 30 sales transactions in a given calendar year or when their amount exceeds PLN 2,000. euro (then there may be less of them).

These are requirements that will simply become a market standard after the DAC7 directive is implemented in Poland. On Allegro's side, we design the process of collecting data from sellers so that it is as little burdensome as possible for them. We also prepare materials for sellers regarding new regulations so that they can properly prepare for them.

Konrad Dobrowolski from OLX assures that DAC-7 does not impose any additional tax obligations on users of advertising websites. However, there is no doubt that people who exceed the assumed ceiling of 30 transactions and PLN 2,000. euro, and they do not settle them, they will almost certainly be summoned to the Tax Offices for explanations. Finally, the new regulations aim to ensure equal competition, among other things, by eliminating or at least limiting the so-called gray zone.

Importantly, digital platforms will be obliged to provide data not from July 1, i.e. the date of entry into force of the regulations, but from January 1, 2023. This is because Poland was 1.5 years late in implementing EU regulations. Therefore, if someone exceeded the established ceilings last year, KAS will receive information about it.
