Vinted will send urgent messages to users. They must not be ignored
Sellers on Vinted need to be careful. The platform will soon start contacting sellers whose data will be sent to the Tax Office.
For several months now, the EU directive DAC7 has been in force in Poland, which requires online sales platforms to transfer sellers’ data to the Tax Office. Just recently, the tax office informed that it had not received any information. However, this will soon change. Vinted will be one of the first platforms to start contacting users who have exceeded the set limits.
The sellers’ data will be sent to the tax office
The EU DAC7 directive entered into force in Poland on July 1, 2024. It imposes an obligation on online sales platforms to report to the Tax Office. The tax office will receive data of sellers who made at least 30 sales transactions during the year or their total amount exceeded PLN 2,000. euro. Importantly, Poland was late in introducing the directive, so the tax office will also receive data for the previous year, i.e. 2023.
Pale fear fell upon the sellers. Many people are afraid of being summoned to court for incorrect settlement of sales taxes. Meanwhile, recently the Ministry of Finance claimed that no audits could be carried out for this reason, because no data had yet been sent to the National Tax Administration. Technical work was still underway to enable the receipt of reports. This will change soon, as Vinted reports.
Vinted announced that it will soon contact users who made at least 30 sales transactions last year or whose amount exceeded PLN 2,000. euro. They will be asked to complete their PESEL number. If you don’t receive any message from the platform about this, you don’t have to worry and you don’t have to do anything.
User data is encrypted and secure. Vinted will only ask you for the data necessary to comply with DAC7, and this information will be securely transmitted to the tax office in January of the following year. Transferring user data to tax authorities does not lead to taxation. Taxation is a separate issue that does not depend on the reporting required under DAC7.
– informs Vinted.
Data for 2023 should be sent to the tax office by the end of 2024. However, information for 2024 is to be sent by the end of January 2025. If someone does not complete the form, Vinted is legally obliged to block such an account.
Who will pay the outstanding tax?
Although the EU DAC7 directive itself does not impose any new tax, some people who have incorrectly settled their taxes with the tax office may expect a summons for explanations. Penalties, including the need to pay outstanding tax, cannot be ruled out.
However, this will not apply to everyone. Vinted explains that this only applies to people whose sales were for profit. If we bought a blouse for PLN 30 and then sold it for PLN 20, there is no profit and therefore no need to pay tax. We will not pay tax on private items that belonged to us for at least six months.
Even if the seller makes a profit, he will not pay tax if the sold item was his property for more than 6 months or his total annual income (profits from Vinted, remuneration for work and other income) does not exceed PLN 30,000.
– adds Vinted.
